Art. 32

Remedies for enforcement of rights conferred by this Part

If any of your fundamental rights are violated, you can go directly to the Supreme Court. The Court can issue special orders (writs) to protect your rights. Dr. Ambedkar called this the "heart and soul" of the Constitution - because rights without a remedy are meaningless.

Art. 32A

Constitutional validity of State laws not to be considered in proceedings under article 32

This article was inserted by the 42nd Amendment to prevent the Supreme Court from considering the constitutional validity of state laws under Article 32. It was later repealed by the 43rd Amendment.

Art. 33

Power of Parliament to modify the rights conferred by this Part in their application to Forces, etc

Parliament can modify or restrict fundamental rights for members of the armed forces, police, intelligence agencies, and similar services to ensure they can do their jobs effectively. Discipline in these forces sometimes requires limits on individual rights.

Art. 34

Restriction on rights conferred by this Part while martial law is in force in any area

When martial law is declared in any area (during extreme emergencies), Parliament can pass a law to protect government officials and military personnel from legal action for things they did to maintain order. Your rights may be temporarily restricted during such periods.

Art. 35

Legislation to give effect to the provisions of this Part

Only Parliament (not state legislatures) can make laws to enforce fundamental rights - like defining what counts as "untouchability" and prescribing punishment for it. This ensures uniform protection across all of India.
